Story Time

Last Friday it snowed where I live, nothing heavy just some dust. Me and a friend decide to go offroading in our usual spot. (Mistake 1) My friend hops out and records me doing some donuts (mistake 2)and posts it on Snapchat (mistake 3 AKA the nail in the coffin). Little did we know it was private property and the land owners kid saw my friends post. Flash forward to Wednesday everyone at my school's talking about how my friend and I were in deep shit. Principal and student resource officer (a public schools equivalent to a mall cop) call us into the office. They have the video pulled up and tell us that we're being charged with trespassing and property damage. Needless to say our parents aren't too happy. Lesson: don't do stupid shit

Odd, what do the principle and the student resource officer have to do with this? Did either of them own the property or was it school property? If not, they have not business doing anything about it.

If the land owner wishes to file charges, then the actual police department will be handling the issue, not these two wanna bes.

Not sure about where you live, but everywhere I've ever been the school resource officer is a fully sworn and certified Deputy Sheriff or Police Officer. They are just assigned to the school instead of road patrol, CSI, etc.
SROs generally handle any issues with students while at the school.

But like James said... you live and learn. Hopefully you won't be doing dumb shit like that again.

I know anytime someone was arrested at school, it was a fully clothed officer that arrived and dealt with the issue. No SRO in smaller towns. Could be the difference.

So at what time did it hit you that going online where anyone who wants can read, that it was a good idea to tell the world about this, and even calling it your usual spot? This could be used against you!

Having dealt with cases like this, I can say that without land owner intent of prosecution, the SRO doesn't have a shit to give. Even still, FL doesn't have a criminal charge of "trespassing". Only "Trespassing after warning" which is refusing to leave after being told by property owner. As far as the property damage (criminal mischief) it's really hard to put a price on grass and dirt and without a value, there is no charge. If he destroyed fancy landscaping, thats one thing, but grass grows back on it's own.

Best advice, is be honest the work with everyone. Hiding info or lying will go bad for you. Sounds like most of the evidence is out there, but own up to the mistake, be honest about your intent, and as James said learn from it. We've probably all been there at one point or another, you aren't the first to do stupid shit, and you won't be the last. Keep your head up, but be humble and cooperative.

Speaking of my experience of enforcing the law in NY, the subject could definitely be charged with destruction of private property, and trespass if he passed any signs or took some crazy out of the way route to avoid signs if you could reasonably believe he knew he was on private property at the owners demise. In NY once you reach $800 worth of damage you're a felon.

I can't think of any circumstance where you could go into a field, do donuts and tear up all the grass, and not be breaking the law. Even if its public land, you are destroying property. Nonetheless, I don't think you're a bad kid, and this is the kind of stupid stuff I did when I was a kid too. Actually, what I did was probably worse.
